Discretionary Punitive Sentence Implemented Against One Offender in Sar‑e Pul Province
Based on the decision of the Criminal Chamber of the Court of Appeals of Sar‑e Pul Province, a discretionary punitive sentence was carried out against one individual on the charge of facilitating escape from the home. The sentence was implemented on 25/08/1446 AH.
The Criminal Chamber had sentenced the aforementioned offender to one year of enforceable imprisonment and thirty‑nine lashes as a discretionary (taʿzīr) punishment. The enforcement took place following confirmation by the Supreme Court.
The discretionary punishment was carried out within the premises of the Court of Appeals, in the presence of judicial and administrative personnel of the court as well as a large number of visitors, and was executed against the convicted individual.

Notes on Decree

The enforcement of imprisonment and corporal punishment against an individual in Sar-e Pul Province reflects the continued use of discretionary punishment by Taliban authorities to regulate personal behavior and enforce moral conformity. The imposition of one year of imprisonment and 39 lashes for “facilitating escape from the home,” carried out within appellate court premises following Supreme Court confirmation, underscores the institutionalization of corporal punishment within formal judicial processes. Implemented through proceedings lacking independence and meaningful safeguards, the punishment functions as an arbitrary and coercive practice that criminalizes personal autonomy and freedom of movement, while normalizing physical violence as a tool of governance.
