Decree

Taliban court orders inhumane solitary confinement for detainee in civil dispute, denying visitation and basic rights.

Decree Translation

In a letter sent by the Taliban court to the Taliban command for Herat, it is stated: “Haji Wali Jan, son of Haji Abdul Zahir, has a civil dispute over a vehicle with Mohammad Maroof, son of Ghulam Sarwar. Therefore, the aforementioned defendant, who is currently detained with you, should be confined in a separate room.” The order further specifies: “He should be alone, provided with food and water through a small hole, and no one should be allowed to visit him.”

Notes on Decree

A number of the country’s legal experts consider this action by the Taliban a blatant violation of human rights and the dignity of prisoners. According to them, there is currently no specific law regarding the detention of suspects, and therefore, such an order contradicts all human rights values. This comes at a time when the international community has stipulated that recognition of their regime depends on respecting human rights.
