Decree

Arbitrary and degrading detention in Taliban Prisons.

Decree Translation

Date: 1401/01/25 In a letter sent by the Taliban court administration to the Taliban command in Herat, it states:

"Haji Wali Jan, son of Haji Abdul Zahir, has filed a civil lawsuit against Mohammad Maroof, son of Ghulam Sarwar, regarding the ownership of a vehicle. Therefore, the mentioned defendant, who is currently in your custody, should be confined in a separate room."

The order further states: "No one should be with him, food and water should be provided through a small opening, and no one should be allowed to visit him."

Notes on Decree

This official decree reflects a punitive and degrading approach to detention, particularly troubling given that the underlying dispute is civil in nature. The use of solitary confinement—denying all human contact, restricting food and water delivery, and forbidding visits—could amount to inhuman and degrading treatment. It suggests a broader pattern of potential abuse and disregard for basic rights in Taliban-run detention facilities, where even individuals involved in non-criminal cases may be subjected to conditions that could be considered forms of persecution or even torture under international human rights standards.
