Date: 24/12/1444 The High Court of the Islamic Emirate of Afghanistan issued a statement on 24/12/1444 (corresponding to July 13, 2023), stating that four individuals, along with one woman, were apprehended in a case involving immorality and vice in the Qargha area. They were arrested by security forces and transferred to the primary court of Paghman district, Kabul province, for further investigation. After comprehensive inquiries, the primary court sentenced each of the suspects to three months of imprisonment and twenty lashes. Later, the case was referred to the appellate court of Kabul province, and then to the Supreme Court, where the verdicts of the primary court were upheld in both instances.
This case highlights the Taliban judiciary's use of corporal punishment and short-term imprisonment for so-called "moral" offenses, reinforcing a system that bypasses international due process standards. The inclusion of a woman among the convicted further reflects gender-based targeting under vague morality laws. Upholding such verdicts at every judicial level underscores institutional endorsement of punitive, non-transparent justice mechanisms that violate rights to a fair trial, bodily integrity, and personal autonomy.
