Decree Translation
Date: 20th of Muharram, 1445 Hijri (equivalent to approximately August 07, 2023), according to the verdict of the Faryab provincial court and the approval of the honorable higher authority of the appellate court, in the premises of the trial court, disciplinary punishment was imposed on more than four individuals accused of crimes of adultery and sodomy. The gathering was initiated for the implementation of disciplinary punishment on the mentioned accused. Maulawi Abdul Wahab (Zahid), the head of the Faryab trial court, officials from other governmental and military departments, respected scholars, and a large number of devout people from the province were present. Disciplinary punishment (29 lashes for each individual accused of the crime of illegitimate relations and 30 lashes for each individual accused of the crime of sodomy) was imposed on each of the accused.
The public flogging of individuals in Faryab province for offenses such as adultery and sodomy reflects the Taliban’s continued reliance on corporal punishment, in violation of international human rights norms. The use of public lashings not only constitutes cruel, inhuman, and degrading treatment but also undermines the right to a fair trial and due process. These actions signal a broader pattern of arbitrary punishment under a judicial system lacking transparency and impartiality, particularly targeting personal autonomy and reinforcing discriminatory norms, including against women and LGBTQ+ individuals.
