Decree

Detention of woman refusing forced marriage in Kunduz province.

Decree Translation

Date: 09/04/1403 Local sources in Kunduz province reported that the Taliban have imprisoned a girl for refusing forced marriage in the province center. Sources confirmed to the daily "8 Sobh" Newspaper on Saturday, July 30, that the Taliban have detained this girl along with her father for the past four days in Kunduz province center.
According to sources, Mawlawi Rahmatullah Hanafi, the head of the Criminal Court of the Primary Urban Court of this province, has warned that if the girl does not consent to marriage, her marriage will be solemnized (next Saturday).
Sources identify the girl as Shaista (a Persian Name) and add that a year ago, she was engaged to someone chosen by her father whom she had never met. According to sources, the girl is unwilling to marry a man she does not know.
Sources further mention "Shaista" is 25 years old and works as a vaccinator. Sources emphasize that the girl's fiancé enjoys the Taliban's support.

Notes on Decree

The detention of Shaista for refusing a forced marriage illustrates the Taliban's use of judicial and carceral systems to coerce women into marriages without consent. The involvement of a Taliban-supported fiancé and a court official threatening to solemnize the marriage without her will highlights the collapse of personal autonomy, legal safeguards, and gender equality. This case underscores the institutionalization of forced marriage practices and the criminalization of female resistance in Taliban-controlled Afghanistan.
